Why a delivery note does not protect the seller
In Naveen Kumar v. Vijay Kumar (2018), the Supreme Court of India ruled that the person named as the owner in official RTO records on the date of an accident remains liable to third-party victims. A private sale agreement, delivery note or power of attorney does not absolve the seller if the RC is not updated.
To protect sellers, the Central Motor Vehicles Rules (CMVR) introduced Form 29C in 2022 for sales to registered used-car dealers. Once a recognized dealer accepts possession through Form 29C, dealer liability applies until the car is resold.
Statutory forms required for vehicle ownership transfer
Obtain duplicate copies of Form 29 and Form 30 with signatures from both buyer and seller. Keep chassis pencil imprints and tax token receipts ready for physical submission if required by your state RTO.

Moving a vehicle across states under Section 47
If you move a vehicle to another state for more than 12 months, Section 47 of the Motor Vehicles Act mandates re-registration. You must obtain Form 28 (NOC) from the home state RTO, pay new lifetime motor vehicle tax in the destination state, and apply for a pro-rata tax refund from the origin state within the statutory timeline.

Step-by-step ownership transfer checklist
- Step 1: Check and clear all pending traffic e-challans on the vehicle.
- Step 2: Obtain Form 35 loan hypothecation termination from the bank if financed.
- Step 3: Execute Form 29 (in duplicate) and Form 30 with buyer and seller signatures.
